Terms of Service
Please read these terms carefully before using Eventor. By accessing or using our platform, you agree to be bound by the following terms and conditions.
Summary: These Terms govern your use of the Eventor platform. By creating an account or purchasing a ticket, you confirm that you have read and agree to these Terms. If you do not agree, please do not use Eventor.
Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Eventor (Pty) Ltd ("Eventor", "we", "us", or "our"), governing your access to and use of the Eventor website and platform (the "Platform").
By accessing or using the Platform — including browsing events, creating an account, purchasing tickets, or listing an event — you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the Platform on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.
If you do not agree to these Terms, you must not access or use the Eventor Platform.
Definitions
For the purposes of these Terms, the following definitions apply:
- "Platform" means the Eventor website, web application, and any related services we operate.
- "User" means any individual or entity that accesses or uses the Platform, whether registered or not.
- "Attendee" means a User who browses events or purchases tickets through the Platform.
- "Organiser" means a User who creates and publishes events on the Platform.
- "Event" means any concert, festival, exhibition, workshop, sports event, or other gathering listed on the Platform.
- "Ticket" means the digital record of a booking that grants an Attendee access to an Event.
- "Content" means any text, images, descriptions, or other material submitted to the Platform by Users.
- "POPIA" means the Protection of Personal Information Act 4 of 2013.
Eligibility
To use the Eventor Platform, you must:
- Be at least 18 years of age, or have the consent of a parent or legal guardian if you are between 13 and 17 years of age;
- Have the legal capacity to enter into a binding agreement under South African law;
- Not be prohibited from using the Platform under any applicable laws or regulations;
- Provide accurate, current, and complete information during registration.
Eventor reserves the right to refuse access to the Platform to any person at its sole discretion.
User Accounts
4.1 Registration
Certain features of the Platform require you to create an account. You agree to provide accurate and complete information when registering and to keep your account details up to date.
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at iam@niza.co.za if you suspect any unauthorised use of your account.
4.3 One Account Per Person
Each User may maintain only one account. Creating multiple accounts to circumvent restrictions, bans, or limitations is prohibited and may result in termination of all associated accounts.
4.4 Account Termination
You may close your account at any time by contacting us. We reserve the right to suspend or permanently terminate accounts that violate these Terms.
Tickets & Bookings
5.1 Ticket Purchase
When you purchase a ticket through Eventor, you enter into a direct agreement with the Event Organiser for access to that Event. Eventor acts as an intermediary ticketing platform and is not a party to the agreement between Attendees and Organisers.
5.2 Ticket Delivery
Upon successful payment, your ticket will be made available in your account under "My Tickets". A confirmation email will also be sent to your registered email address. You are responsible for ensuring your contact details are correct.
5.3 Ticket Validity
Tickets are valid for the specific Event, date, time, and ticket type stated. Eventor cannot guarantee entry if an Attendee presents an invalid, expired, or fraudulent ticket.
5.4 Cancellations & Refunds
Refund and cancellation policies are determined by each individual Organiser and are displayed on the relevant Event page before purchase. In the event that an Organiser cancels an Event, Eventor will facilitate a full refund to affected Attendees.
Eventor is not liable for any losses incurred by an Attendee as a result of an Event being cancelled, postponed, or materially changed by an Organiser.
Event Organisers
6.1 Listing Events
By listing an Event on the Platform, you represent and warrant that: the Event is real and will take place as described; you have all necessary licences, permits, and permissions required to host the Event; the Event content does not infringe the rights of any third party; and the Event complies with all applicable South African laws and regulations.
6.2 Organiser Responsibilities
Organisers are solely responsible for the accuracy of Event information, the conduct of the Event, and any claims arising from Attendees. Eventor reserves the right to remove any Event listing that, in its sole judgment, violates these Terms or is inappropriate.
6.3 Prohibited Events
The following types of events may not be listed:
- Events that promote illegal activity, discrimination, or hatred;
- Events that are misleading, fraudulent, or designed to deceive Attendees;
- Events that violate any applicable South African law or regulation;
- Events intended for persons under 18 that are not appropriately managed.
6.4 Payouts
Organisers will receive net ticket revenue (after applicable platform fees) within 5 business days after the Event date, subject to no outstanding disputes. Payouts are made to the South African bank account provided during account setup.
Payments & Refunds
7.1 Payment Processing
All payments on the Platform are processed in South African Rand (ZAR) through Eventor's certified third-party payment processor. By completing a purchase, you authorise the charge to your nominated payment method.
7.2 Platform Fees
Eventor charges a service fee on paid ticket transactions. This fee is disclosed prior to checkout. Free events incur no platform fees. Fees are non-refundable unless the Event is cancelled by the Organiser.
7.3 Refund Process
Where a refund is approved, it will be processed to the original payment method. Card refunds typically reflect within 5–10 business days. EFT refunds are processed within 3–5 business days. Eventor will notify you by email once a refund has been initiated.
7.4 Disputed Transactions
If you believe a payment has been processed in error, please contact us at iam@niza.co.za within 30 days of the transaction. We will investigate and respond within 5 business days.
Acceptable Use
You agree not to use the Platform to:
- Violate any applicable law, regulation, or third-party rights;
- Post false, misleading, or fraudulent content or Event listings;
- Attempt to gain unauthorised access to any part of the Platform or its systems;
- Scrape, copy, or systematically extract data from the Platform without prior written permission;
- Resell or transfer tickets purchased on the Platform in violation of an Organiser's stated policies;
- Use automated tools, bots, or scripts to interact with the Platform;
- Engage in any conduct that disrupts, damages, or impairs the Platform or other Users' experience;
- Upload or transmit malicious code, viruses, or other harmful content.
Violation of this section may result in immediate suspension or termination of your account and, where appropriate, referral to law enforcement authorities.
Intellectual Property
9.1 Eventor IP
All content on the Platform that is created or owned by Eventor (Pty) Ltd — including but not limited to the Eventor name, logo, design, software, and written content — is the intellectual property of Eventor (Pty) Ltd and is protected under applicable South African and international intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without prior written consent.
9.2 User Content
You retain ownership of any Content you submit to the Platform (such as Event descriptions, images, or profile information). By submitting Content, you grant Eventor a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that Content for the purpose of operating and promoting the Platform.
9.3 Reporting Infringement
If you believe that any Content on the Platform infringes your intellectual property rights, please notify us at iam@niza.co.za with full details of the alleged infringement.
Privacy
Eventor is committed to protecting your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). Our Privacy Policy explains how we collect, use, store, and share your personal data, and forms part of these Terms by reference.
By using the Platform, you consent to the processing of your personal information as described in our Privacy Policy. You have the right to access, correct, and request deletion of your personal information. To exercise these rights, contact our Information Officer at iam@niza.co.za.
Eventor will never sell your personal information to third parties. Data is shared only where necessary to provide our services (e.g., payment processors) or where required by law.
Limitation of Liability
To the maximum extent permitted by applicable South African law, Eventor and its directors, employees, and agents shall not be liable for:
- Any indirect, incidental, special, or consequential loss or damage arising from your use of the Platform;
- Any loss arising from the cancellation, postponement, or changes to an Event by an Organiser;
- Any unauthorised access to or alteration of your account or data;
- Any conduct or content of third parties on or off the Platform;
- Any interruption, suspension, or termination of the Platform or its services.
Where liability cannot be excluded by law, Eventor's total liability to you shall not exceed the amount you paid to us in the 12 months preceding the event giving rise to the claim.
Termination
Eventor reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, if we reasonably believe that you have violated these Terms, engaged in fraudulent or illegal conduct, or posed a risk to the Platform or other Users.
You may terminate your account at any time by contacting us at iam@niza.co.za. Upon termination, your right to use the Platform will immediately cease. Sections relating to intellectual property, limitation of liability, and governing law shall survive termination.
Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
Before initiating any legal proceedings, the parties agree to attempt to resolve any dispute amicably through good-faith negotiation for a period of not less than 30 days.
Changes to Terms
Eventor may update these Terms from time to time to reflect changes to our services, legal requirements, or business practices. When we make material changes, we will notify registered Users by email and update the "Last updated" date at the top of this page.
Your continued use of the Platform after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Platform and may close your account.
